Terms & Conditions for Due West Charters.

These may be subject to change without notice.

Payment / Refund Policy

Due West Charters operates a no-refund policy on deposits paid, where if you cancel a booking, at any time, prior to the day of your event, you will forfeit your deposit. You may also be subject to applicable associated fees and charges imposed by third parties or organisations, this includes, but not limited to, non-refundable deposits paid to other organisations as part of the Event, merchant fees, bank fees etc.

A 30% deposit of the total booking fee is required to secure your booking with Due West Charters. The deposit must be paid within 7 days of making a booking. The remaining balance must be paid in full 30 days prior to the booked charter date. Due West Charters reserves the right to release the booking date and booked charter if the remaining balance is unpaid within 25 days of the booked tour date.

Cancellations

Cancellation of a booking made 2 weeks or less prior to the event will forfeit 100% of the booking cost. You may also be subject to applicable associated fees and charges imposed by third parties or organisations, this includes, but not limited to, non-refundable deposits paid to other organisations as part of the Event, merchant fees, bank fees etc. The customer and/or hirer of the vessel, as stated on the booking form will be responsible for and required to make these payments.

Covid 19 Policy

All shared surfaces and areas will be thoroughly cleaned prior to a change over of guests. Any shared utensils will be cleaned thoroughly prior to a changeover of guests. Where and when possible, shared utensils will be disposable.

Any and all changes to bookings that need to be made due to Covid 19 restrictions that are imposed on operations by the state and federal government will incur a refund of 70%percent of the full booking fee IF the booking fee has been paid in full. Any deposit paid is non-refundable. The 30% deposit fee is transferable to a later date in the case that the original booking date is impacted by an unforeseeable, government imposed Covid restriction.

Prices

Charter boat hire prices, specials and cruise deals are subject to availability and can change without prior notice. The customer/ hirer of the vessel must agree and sign an acknowledgment to agree to Due West Charters’ Terms and Conditions on the booking form in order for the relevant booking to be secured and finalised. 

Charter Vessel Code of Conduct

The vessel owners, managers and employees acknowledge that they have read and are familiar with the Ferry and Charter Vessels Code of Conduct. They acknowledge that they have conducted a pre charter safety check and identified, assessed and taken measures to control risks to passengers and themselves before and while operating each boat charter. Any damage caused to or noticed on the vessel during the duration of the charter must be notified to the skipper of the vessel immediately.

Privacy Policy

The information we collect is required by us under State and Federal Law as part of our Charter Operating License. Any information collected will not be shared, sold, or otherwise used for any other purpose than for the efficient running of the Company, providing information directly to you, the Customer, from us, the Company or as required under State or Federal Law.  

Operational

All children under the age of 18 must be accompanied by an adult on all Due West Charter trips. Safety is a priority; life jackets and floatation aids are available to guests on request who require extra support when in the water. The boat skipper has the right to refuse entry into the water for any guest who appears to be at risk of personal injury and/or death if they partake in a swimming activity. All passengers swim and enter the water at their own risk. The owners and employees of Due West Charters take no responsibly for any injury or death caused by passengers entering the water.

Activities and itineraries are at the discretion of the boat skipper on the day. These decisions will be made with guests’ safety and best interests in mind.

Charter destinations are subject to weather conditions. Any change in destination will be made to ensure the safety and comfort of guests. No refunds or discounts will be given due to a change in charter destination.

Any guest consuming alcohol on board must do so in a responsible manner. Guests consuming alcohol will responsible and liable for their own actions. Due West Charters and all staff of Due West Charters will not take any responsibility for any personal injuries to self and/or others, all damages or death caused by a guest under the influence of alcohol.

Any external services organised privately by the customer of Due West Charters is the sole responsibility of said customer. Due West Charters takes no responsibility for charges incurred by outside organisations organised by our customer. If there are any changes to the charter itinerary, charter time, charter pickup location and charter destination it is Due West Charter’s customer’s responsibility to communicate these changes to said outside organisation.

DISCLAIMER AND RELEASE

Participation in certain activities conducted by Due West Charters including snorkelling and swimming can carry risk of damage to property, personal injury or death.

You and your guests must exercise your own skill and judgment in regard to the risks that may be posed by undertaking such activities and to ensure that you are capable and equipped to undertake any activity conducted by or in association with Due West Charters. Guests who come on board and can not swim or deem themselves a weak swimmer must make the crew aware that they are unable to swim so necessary safety precautions are put in place. Failure to notify the crew could lead to the passenger being asked to disembark the boat at the nearest jetty. Due West Charters and staff of Due West Charters take no responsibility for exercising this judgment on your behalf.

Guests and passengers on Due West Charters acknowledge that their participation in any activities conducted by or in association with Due West Charters are aware of the above and participate at their own risk.

  • To the fullest extent permitted by law and by reading and acknowledging the detail of this document I/we release Due West Charters and staff of Due West Charters from all liability arising from my/our participation in any activity conducted by, or in association with, Due West Charters.

  • I/we acknowledge that if I/we have any questions or concerns relating to swimming/ snorkelling, or any pre-existing medical conditions/allergies that I/we must speak to a staff member of Due West Charters at the commencement of the tour.

  • I/we acknowledge that photographic images and/or video footage of myself and others onboard can and may be used for promotional purposes by Due West Charters through online platforms such as social media and website listings. I acknowledge that if I/we have any questions or concerns relating to our image/s being used in this manner that I/we must speak to a staff member of Due West Charters at the commencement of the tour.

Guests on Due West Charters understand, acknowledge and agree to the above terms and conditions. These terms and conditions must be agreed to prior to boarding one of Due West Charters’ vessels and partaking in a tour operated by Due West Charters.
